மத்திய அமைச்சர் சுஷ்மா ஸ்வராஜ் பதவிவிலகவேண்டும்

ரோஹித் வெமுலா தலித் இல்லை எனக் கூறும் பாஜக அமைச்சர் சுஷ்மாஸ்வராஜ் அது தொடர்பான உச்சநீதிமன்றத் தீர்ப்பைப் படிக்கவேண்டும். Rameshbhai Dabhai Naika vs State Of Gujarat & Ors என்ற வழக்கில் 2012 ஆம் ஆண்டு சனவரி 18 ஆம் நாள் நீதிபதிகள் அஃப்டாப் ஆலம், ரஞ்சனா ப்ரகாஷ் ஆகியோரைக்கொண்ட உச்சநீதிமன்ற அமர்வு அளித்த தீர்ப்பில் பத்தி 43 ல் இத்தகைய சிக்கல் குறித்து தெளிவாகக் கூறப்பட்டுள்ளது. அந்தத் தீர்ப்பின்படி ரோஹித் வெமுலாவின் தந்தை பிற்படுத்தப்பட்ட சாதியாக இருந்தாலும் அவர் தனது மனைவியையும் குழந்தையையும் கைவிட்டுவிட்டுச் சென்ற காரணத்தால் அதன்பிறகு ரோஹித் தனது தாயின் பராமரிப்பில், தாயின் சமூகச்சூழலில் வளர்ந்த காரணத்தால் தாயின் சாதியைச் சேர்ந்தவராகவே கருதப்படவேண்டும். அதுவே சட்டபூர்வமாக உச்சநீதிமன்றத்தால் ஏற்கப்பட்ட நிலையுமாகும். இதை அறியாமல் பாஜகவினர் பேசுகின்றனர். 

சட்டத்தை அறியாதவர்கள் மத்திய அமைச்சர்களாக இருப்பது இந்த நாட்டுக்கு அவமானம். உச்சநீதிமன்றத் தீர்ப்புக்கு முரணாகப் பேசிய அமைச்சர் சுஷ்மா ஸ்வராஜ் பதவி விலகவேண்டும் என ஜனநாயக சக்திகள் வலியுறுத்தவேண்டும். 

உச்சநீதிமன்றத் தீர்ப்பின் குறிப்பிட்ட பகுதியை இங்கே தருகிறேன்: 

 " The determination of caste of a person born of an inter-caste marriage or a marriage between a tribal and a non-tribal cannot be determined in complete disregard of attending facts of the case. In an inter- caste marriage or a marriage between a tribal and a non-tribal there may be a presumption that the child has the caste of the father. 

This presumption may be stronger in the case where in the inter-caste marriage or a marriage between a tribal and a non-tribal the husband belongs to a forward caste. But by no means the presumption is conclusive or irrebuttable and it is open to the child of such marriage to lead evidence to show that he/she was brought up by the mother who belonged to the scheduled caste/scheduled tribe. 

By virtue of being the son of a forward caste father he did not have any advantageous start in life but on the contrary suffered the deprivations, indignities, humilities and handicaps like any other member of the community to which his/her mother belonged. Additionally, that he was always treated a member of the community to which her mother belonged not only by that community but by people outside the community as well."
